Microbe Mogul End User License Agreement

1. Acceptance and eligibility

This End User License Agreement (the “EULA”) is between you and Gunnar BioTechnology LLC (“Gunnar BioTech,” “we,” “us,” or “our”), a Florida limited liability company. It governs the Microbe Mogul game, its installer, documentation, and the updates we provide (collectively, “Microbe Mogul” or the “Game”).

You accept this EULA by selecting the agreement checkbox when you buy Microbe Mogul, or by installing or using the Game. If you do not agree, do not install or use Microbe Mogul.

You must be at least 13 years old to use Microbe Mogul. If you are under 18, you must have permission from a parent or legal guardian, who agrees to this EULA on your behalf. If you use Microbe Mogul for a school or other organization, you represent that you have authority to accept this EULA for your use on the organization’s behalf.

2. License grant

Subject to payment, a valid license, and compliance with this EULA, Gunnar BioTech grants the licensed player a limited, non-exclusive, perpetual, non-transferable, revocable license to install and play Microbe Mogul on computers that the player personally owns or controls, for the player’s own use. “Perpetual” means the license has no subscription renewal or preset expiration date; it remains subject to technical compatibility, refunds, and termination under this EULA.

Each license is for one individual player. A parent or legal guardian may purchase for and authorize one player age 13 through 17. A school or other organization needs one license for each player; a single license may not be installed on shared computers for use by several people.

3. License key, downloads, and updates

Your license key is sent to the email address used at checkout. You need it to download the installer and to download updates from inside the Game. Microbe Mogul does not require online activation: once installed, it can be played without an internet connection.

When you download the installer or an update, your license key is sent to Gunnar BioTech’s licensing service, which checks it before providing a short-lived download link. The Game may also check a public file to learn whether a newer version exists; you can turn that check off in the Game. You may not share your license key, publish it, or use another person’s key.

4. Restrictions

Except where applicable law expressly permits an activity despite this restriction, you may not:

• copy Microbe Mogul or its installer except for installation on your own computers and a reasonable backup;
• distribute, publish, upload, rent, lease, lend, sublicense, sell, assign, or transfer Microbe Mogul, its installer, or a license key;
• share a single-player license among multiple players;
• reverse engineer, decompile, disassemble, or attempt to discover source code, except as applicable law permits;
• modify, or distribute modified versions of, the Game or create derivative works from it;
• bypass or interfere with the license-key, download, update-signature, security, or access controls;
• remove proprietary or third-party notices; or
• use Microbe Mogul unlawfully or to infringe another person’s rights.

You may take screenshots and record or stream your own gameplay for personal, educational, or non-commercial purposes, and teachers may show the Game in class, as long as you do not distribute the Game itself.

5. Ownership

Microbe Mogul is licensed, not sold. Gunnar BioTech and its licensors retain all ownership and intellectual-property rights in Microbe Mogul, including its code, artwork, text, design, documentation, names, and all copies and derivative works. No rights are granted except those expressly stated in this EULA.

6. Your saved games

Your saved games and settings are stored on your own computer and are not sent to us. You are responsible for backing them up. Uninstalling or updating Microbe Mogul does not delete your saves, but we cannot recover saves that are lost or damaged on your device.

7. Educational content

Microbe Mogul is a game that teaches how a cell’s metabolism works, starting with glycolysis. To keep it playable, it simplifies real biochemistry, speeds up or slows down processes, and uses stand-ins for parts of the cell that are not in the Game yet. The Game’s glossary points out the main simplifications. Microbe Mogul is not a textbook, laboratory tool, medical device, or source of medical or nutritional advice, and its numbers should not be relied on for coursework, research, or health decisions without checking an authoritative source.

8. Updates, compatibility, and support

We may offer updates, new content, compatibility fixes, documentation, or support, but do not promise any particular feature, content, update, response time, or compatibility with future hardware, operating systems, or third-party software. We do not promise updates or support indefinitely. A future product, sequel, or version for another platform may require a separate purchase. Updates we provide remain subject to this EULA unless accompanied by different terms.

Updates installed from inside the Game are checked against our digital signature before they run. Only install Microbe Mogul from our website or another source we have authorized.

9. Third-party components

Microbe Mogul includes third-party and open-source components, such as its graphics library, cryptography library, and fonts, that are governed by their own license notices. Those notices are installed with the Game and control the applicable components to the extent required by their terms. Nothing in this EULA limits rights granted under an applicable open-source license.

10. Privacy

Our Privacy Notice explains what the licensing service and website collect and how it is used. The Game itself does not collect or send personal information, analytics, or advertising data.

11. Store copies

If you obtain Microbe Mogul through an app store or other marketplace, that store’s terms and refund process also apply to your purchase, and the store, not Gunnar BioTech, handles payment, downloads, and updates. This EULA continues to govern your use of the Game. Licenses bought in one store or on our website do not carry over to another platform.

12. Refunds and termination

The Refund Policy applies to eligible purchases made on our website. A full refund deactivates the associated license key, after which it can no longer download the Game or its updates, and you must stop using and uninstall all copies installed under it.

This EULA terminates automatically if you materially breach it and do not cure a curable breach after reasonable notice, or immediately where the breach cannot reasonably be cured, involves fraud, unlawful distribution, or circumvention of licensing or security controls. Upon termination, you must stop using and uninstall Microbe Mogul. Sections intended by their nature to survive, including ownership, disclaimers, liability limits, governing law, and accrued payment obligations, continue after termination. Non-waivable legal rights remain unaffected.

13. Disclaimer of warranties

To the fullest extent permitted by law, Microbe Mogul and related services are provided “as is” and “as available.” Gunnar BioTech disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that Microbe Mogul will be uninterrupted, error-free, completely secure, or compatible with every system, or that its educational content is complete or suitable for a particular course or purpose. Where a warranty cannot lawfully be excluded, this disclaimer applies only to the maximum extent permitted.

14. Limitation of liability

To the fullest extent permitted by law, Gunnar BioTech and its members, employees, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, consequential, or punitive damages, or for lost profits, revenue, data, saved games, opportunities, or business interruption, arising from or related to Microbe Mogul, even if advised that such damages were possible.

To the fullest extent permitted by law, our total liability arising from or related to Microbe Mogul will not exceed the amount paid to us for the license associated with the claim. These limitations do not apply to liability that cannot lawfully be excluded or limited.

15. Governing law and courts

Florida law governs this EULA, without regard to conflict-of-law principles. Any lawsuit arising from or related to this EULA or Microbe Mogul must be brought in a state or federal court with jurisdiction in Hillsborough County, Florida, and each party consents to those courts. This does not prevent an eligible individual small-claims action or the exercise of a non-waivable legal right.

This EULA does not require mandatory arbitration.

16. Changes, severability, and complete agreement

The version you accept governs until you accept a later version. We may post a revised EULA for future purchases or updates and will identify the new version and its effective date. If a provision is unenforceable, it will be enforced to the maximum extent permitted and the remainder will continue in effect. Failure to enforce a provision is not a waiver.

This EULA, the Terms of Sale, Refund Policy, Privacy Notice, and any third-party notices that expressly apply form the complete agreement concerning Microbe Mogul, except for a separate written agreement signed by Gunnar BioTech.
